hello im currently following the guide on this site and have fell at the first hurdle. ive sent the letter asking for the T&C's as i dont have them and i have recieved a letter back saying, because the account is paid in full now and the account closed that they dont legally have to send the paperwork out!
so a bit stuck now as im not sure of my rights to see the peperwork. should i just send the complaint questionaire to them and the ombudsman and await reply?
by the way this is with capital one who from what ive seen have been a bit dodgy for PPI claims. im also pursuing a claim with santander for a dfs sofa but have yet to recieve a reply from them.
on both cases i was not aware that PPI was on the loan/card.
help please :money:

That is correct. They are not obliged to do so. I do not know why people are being told to do this as it is no necessary.so a bit stuck now as im not sure of my rights to see the peperwork. should i just send the complaint questionaire to them and the ombudsman and await reply?
Only to the firm, the Ombudsman will not get involved until they have either responded or not done so within 8 weeks of receiving the complaint.by the way this is with capital one who from what ive seen have been a bit dodgy for PPI claims. im also pursuing a claim with santander for a dfs sofa but have yet to recieve a reply from them.
Both should deal with complaints in accordance with the rules of the Financial Services Authority.on both cases i was not aware that PPI was on the loan/card.
How do you know you had cover on either?0 -
thanks for the reply it was very helpful. i think ill fill out the questionaire and send it to both companies and see what happens. is the 8 week thing a law?
how i found out it was on a statement and i hadnt noticed it before. bit daft i know!0 -
What are your grounds for complaining? Simply having cover does not mean it was missold.0
