Mbna help

Hi I'm after some advice, my loan was sold to equidebt by mbna in 2007, I am still repaying this, I asked mbna for ppi refund which was ruled in my favour in July, I was told a cheque ha been set out to me four weeks ago, after two wks they finally accepted it was missing and agreed to get confirmation the cheque was cancelled then send the refund by bacs (this was one of the managers who agreed to this) that was on weds 28th, yesterday I was told the bacs was on it's way by faster payment but surprise surprise it's not there yet!! Today I got a letter from mbna saying they were cancelling my credit accou t and registering a default, all of which was done in 2007, it also said I owe them 214 quid, I have absolutely no idea what they are talking about and obv can't speak to them until mon, so am now stressed that the refund has gone to equidebt leaving me without the money ideaperately need! Contract at wrk about to end so I do need that money to pay my dmp before my next job starts!
Has anyone else had any problems like this or can she any light on whether they can send the money to equidebt as the debt was actually sold? So confused :-(

    Hi there

    I'm sure someone will advise on the correct advice here, but I would ask them to put it into writing of where this amount should be due, and that you were previously told in writing that the refund was being paid directly to you.

    I do understand that any arrears - any refunds maybe awarded towards that debt, but if they told you different from the start, they should have maybe have done this by paying you directly.

  • It sounds like you defaulted on your loan at some point so you owe them.

    Now they have upheld the complaint they owe you. They have set off the money they owe you against the money you owe them and at the end of it you now owe them £214.

    This is permissible under FSA rules.
