Water Damage

I own a downstairs flat which I let out but at present there is no tenant, the upstairs flat was broken into and the hot water cylinder and copper pipes were stolen causing a considerable amount of water to run down into my flat damaging the ceiling, wall and carpet/underlay. I have contacted the letting agent for upstairs who told me to claim off my insurance who intern would claim any costs back from their insurance however I only have buildings insurance and not contents insurance, if the letting agent for upstairs is correct when saying any costs met by my insurance will be paid by his insurance than I should be able to claim directly from his insurance company, this is not the first time I have had trouble with the upstairs flat.
Any help will be much appreciated

The letting agent may have mislead you over this.
It seems unlikely that the upstairs insurer will pay any of your costs (they will only pay out to you if you are able to show the damage has been caused as a result of negligence by the upstairs owner.
(You say this isn't the first time - have the previous times troubles been covered by the upstairs owner's insurance?)
If there is no negligence, then you are on your own as far as your damaged contents is concerned.0
