can someone please help me with any advice please
how long do my children have to stay with me to keep my council tenancy?
i currently have a joint tenancy with my ex partner in a 3 bedroom council property.
unfortunately she has left with the 2 children...son aged 5 and daughter aged 3 (4 next month).
because she has removed herself from the joint tenancy i now have to vacate the property as im told its too big for 1 person.
but i have my children over practicaly every day after school and over night from friday til sundays.
is this enough to let me keep the tenancy on my own or do they have to stay for more nights that 2 a week?

Sounds like you are expecting your family to have a pair of 3 bed places.0

not really...
i just do not want to lose the property that im in now in what i consider to be my home and my childrens home.
might i add i pay full rent and work full time.
i dont want people to assume im on benefits and trying sponge of the state for a free house etc0 -
Then perhaps you should consider renting in the private sector. That way you can have a house as big as you can afford. Unfortunately, demand is such for social housing that the waiting list is full of people with children living with them full time who need a suitably sized property EVERY night of the week. The alternative is to do what many estranged parents do with child care responsibilities and get blow-up/camping beds for when the kids stay.0

nice to see its full of negativity on here.
at the end of the day this is my childrens home, they have lived here all thier life and i do not intend to give it up.
i dont really care about jo public and his family of 8 kids claiming benefits, etc, etc.
i just would like to know if there is a legal minimum number of nights that a child/children are required to stay over night for it be deemed necessary for me to continue living in my property and continue the tenancy on my own.0 -
The answer is....... No.0

Unfortunately as far as the council is concerned you are now a single man in employment. That puts you about as far down the list for state help as its possible to go.0

An individuals employment makes no different to the allocation of social housing unless (in some areas) they are on a very nigh salary.0

Nashd, talk to the Citizens Advice Bureau or perhaps the housing dept at your council. They will be able to provide clear advice, and specific information to your situation.
Keep a written record of how much time your children are spending at your home so that you can give details to any questions from council etc."Does it spark joy?" - Marie Kondo

Right. Go and explain that to the housing department in your local council and watch them :rotfl:0 -

A persons income has no bearing on whether they are accepted for Council / RSL accommodation ... they just have to have the need - and obviously come to the top of the list.0
