DLA rejected...should she appeal

    Absolutely!!

    DLA will pick up on anything that gives them the opportunity of refusing a claim.

    Words such as 'improved', 'coping' 'controlled' etc in whatever context will mean instant refusal.

    The poster really has gone to town by being too honest and giving away far too much info!!!

    As you say, the OP should never have mentioned anything less than 20mins.

    There are two ways of telling the truth to DLA.

    That info will now remain on file should a new claim be put in at any time in the future.

    But are you able to prove what you say by having a professional medical report which confirms exactly what you can and can't do?

    You can say that you can't walk any further than 10 metres before severe discomfort sets in. Fine, but you have to have evidence that backs up that claim!

    Prime example of an honest claimant doing the right thing. There are not that many that report an improvement and ask for the DLA claim to be cancelled.

    Many examples have been shown on this site already. Most are advised to think very carefully about giving up the benefit - you might have improved, but will it last?

    Getting the benefit today at the same rates for exactly the same medical condition and needs as at 10 years ago is nigh on impossible.

    Then you have those claimants saying that they have no intention of giving it up as it took too much to get it in the first place.

    I really feel sympathy for the OP, and I would guess that they didn't have professional advice on how to word the claim form to give them the best chance of getting the award.

    How long was she claiming DLA and how long has she been ill this time?

    Also, what improved her condition last time?

    I wonder if they think it's temporary...

    Does she see a CPN, or psychiatrist?
  • she became ill approx 2002. She was seeing both CPN + psychiatrists over a long period. Eventually she was referred back to her GP, with a recommended dosage of medication. She stayed on this up until approx 2009 and as she showed signs of improvement. She was getting somewhat better, but over the last 6 months or so, her illness is getting worse again. So approx 2 months ago she was given new medication and also got referred once again to a phychiatrist, who is now seeing her on a regular basis.

    @ mcneff - she tends to get up and wonder off in the night, she has to be calmed down to tell her there is no danger to her. I really can't give too much info as it is personal.

    Has the psychistrist supported her claim?
  • She only started seeing him about 2 months ago and they tend to give like 4 to 6 week appointments. On her first appointment, he did mention that she should think about applying for DLA, although no letter was given to support this. It was assumed that since he's mentioned it, that he should back her up too when they do put a claim in, although DLA have stated they have looked at information from GP and psychiatrist already. But i doubt very much that they really have obtained any info/reports from them at all.

    I would ask for a supporting letter if she is going to appeal.
  • the only problem is that the DLA only give you a month to appeal within and her next appointment is at the end of oct.
