Unbelievable

Sold a fully-tested camera on eBay. Buyer now claims it will not read SD card so, despite me being a private seller, he wants a refund.

I have told him that I keep a record of the serial no.s of items I sell, so hopefully if he is trying to pull a scam then I can catch him out and report him to eBay and the Police.
I do of course have the F/b he left me which states 'Fast delivery. Camera works perfectly'.

One thing is for sure, I wont be refunding the guy until I have taken the camera in to work and used the inspection equipment to examine it closely for user inflicted damage.

    Makes no difference what you do, Ebay will refund him whether or not you do, if he opens a snad and shows delivery or attempted delivery to you. The serial number and testing will not stop that.

The interesting thing is that the DSR's state a customer can return an item to a seller and you would have to issue a full refund but this is only if the item is in its original condition that you supplied it in. This isn;t the case here as it has gone out working and is being returned faulty so I guess eBay would want some proof that it was in working order before you sent it which I'm not sure how you would prove.

    It's been known for sellers to win a Not As Described case when the item returned damaged, but they're not so common!

    So long as I get my item back undamaged to resell, I don't mind refunding, but if a seller is refusing a refund buyers can 'damage' an item to create a reason for the return.

    It's really in seller's own interest to refund because cases count against your seller account on eBay and you can find your selling restricted.

    Agree with MissGivings - as eBay provide protection for SNAD disputes, sellers are ...encouraged to accept returns on change of mind because otherwise their buyer might damage it simply to get a refund.

    If you are a commercial seller your buyer has other rights which they can enforce by going to Trading Standards or taking legal action if it is not covered by eBay (which DSR returns aren't, funnily enough).

    I simply say if someone is unhappy with an item, private or business, they can return it for a refund. It probably saves a lot of hassle.

    I have no issues with refunding at all. The sender would have to wait for me to receive and check the item to see if it were damaged by them first though.

    In this case, the buyer contacted me to let me know they had taken it to a camera shop who looked at it and discovered a pin had been bent. He has now had the problem fixed.
    Had he sent it back, I would have spotted the problem, fixed-it and then offered to return it to him without further charge.

    SNAD doesn't quite work that way, if they returned it after initiating a PayPal claim then you would be forced to refund as soon as you received it back...assuming the buyer was intelligent enough to send it by sd or something.

    I cannot argue with this as I don't know eBay well enough but I struggle to believe that the DSR's apply to every site on the planet other than eBay. They can't make up their own rules.

    The difference is with ebay is that they still allow the notion of 'private' sellers, ie non business sellers and as such the DSRs do not currently apply to private sales. Other sites like Amazon, Play etc do not show a difference between private and business sellers so DSRs are applied across the board.

    Any seller on Amazon therefore is required to refund any item purely if buyer changes their mind.
