Paypal Problem...please help!

Hi guys,

This relates to an earlier post I made. A seller wouldn't complete a sale, so I claimed INR through paypal.

I made the claim and the seller responded apologising and giving me a full refund. The claim was pending review by the paypal and I received the following email yesterday:

" Dear Irn-Bru_kid

We have concluded our investigation into your case and have decided in your
favour.

We were able to recover 255.00 GBP, and this amount has been credited to
you. Please allow five working days for this adjustment to be posted.

If you are due any additional funds, we will make our best effort to
recover the balance from the seller.


If the seller's account has insufficient funds to complete the refund owed
to you, please be assured that we will take appropriate action against the
seller's account, which may include limitation of the seller's account
privileges"

Then a few hours later I receive this from paypal:

"Dear Irn-Bru-Kid,

The refund sent by (sellers details) did not clear from the sender's bank. You have not received funds for this payment in your PayPal account.

Please contact (sellers details) regarding this refund"

What is going on? Are paypal seriously telling me I can't get my money back?

I'm a bit frantic and would appreciate your advice.

    Have you tried phoning paypal? If the funds were on hold then the buyer shouldn't have been able to withdraw them into their bank account, so Paypal should still have it.
    The payment did clear from your account didn't it?

    Hi Hermum,

    Yes, I paid by credit card as I always do for larger purchases.

    Its showing in both paypal and ebay as refunded. I have just sent a very snotty email to paypal and told them to get it sorted.

    Do you think I should dispute it through ebay as well?

    No, it's Paypal the issue is with.
    I would be phoning them myself.
    The seller refused to sell due to their policy of putting a 21 day hold on the payment, you've not left positive FB, the seller can't prove delivery & it isn't over 21 days, so why have they gone against their own policy & released the money?
    That's what I would be asking them.

    I really think it is an outrageous set up. I always thought if a claim is made for INR, seller admits and refunds, there are no issues with getting your refund. Paypal pays up and pursues the monies from the seller.

    Clearly I have been mistaken. Also, the seller hadn't received payment anyway. They were on a 21 day hold. Of course, I only know this because the seller told me, but maybe that wasn't the case at all.

It seems that Pay pal aren't too bothered as they received their fee's etc. I seem to recall that Pay Pal used to refund the money regardless and they would then refer the other party to DCA's to get their money back, seems they may not be offering this at this time.

    I would be just as angry OP. I'm wondering if this issue could be seen as 'theft' and reported to the police as such. There has been a few cases in the press lately where people have received and kept funds when they haven't had the good to sell.

    Thanks for your input, much appreciated. I would hate to think that I would need to resort to the 'theft' thing. If all else fails, I assume I can go through my cc company and do a chargeback. Again, virgin territory for me as is the paypal dispute.

    Thanks for that, pipped me to the post! Again, I hope I don't need to pursue a chargeback. This is an outrageous situation and I must be covered by some kind of protection from ebay/paypal

    "If PayPal determines a Claim in your favour, PayPal will re-imburse you the full purchase price of the item and original postage costs only"

    So they found in my favour and now I have a fight on my hands to get my money

    A long time ago, I had a similar situation. My credit card company got my refund from paypal. For all the trust and safety speak that paypal put out, they are not governed by the banking code etc, which means they don't have to follow it. However, a cc company can force their hand ... of course, it shouldn't have to be this way!
