Hi all 
I wonder if some kind soul can help. My parents brought me an ipod touch for my birthday last year (August 2010). I have had a problem with downloading a few games and thought nothing of it until now as there is a game I really wanted to download. My parents were sold the Ipod in Argos as a 3rd generation however i have now found out it is a 2nd generation which explains the problems with being unable to download certain games. Do we have a leg to stand on about this?

Given that it is over 14 months ago, I would say nothing can be done. How do you prove they misold it, unless you have the original receipt, packaging and it states 3rd gen on there somewhere and can prove the iPod came from that packaging.Mansion TV. Avoid at all cost's :j0

I do have the original receipt and the packaging (not at home at the moment so can't check the package) but the receipt doesnt say what generation, although from the price at the time surely they should know it should have been 3rd gen?0 -
The 8gb 3rd gen are exactly the same as an 8gb 2nd gen.
If a game says you need a 3rd gen i'd assume itmeans a 3rd gen 16 or 32gb as these have a faster processor.
If you have a larger capacity one it may be worth checking the argos code on your receipt to see which model you were billed for.0 -
Ah did not know that. Found this post on here, seems they have had the same problem, but not much joy from Argos.

the box and ipod will have identical imei markers which proves its from the same box0

That all said I can't understand why any game will not work if it is upgraded to the latest firmware,maybe someone can enlighten me?
