Hi
I was part time self employed earning under threshold for Class2 NI, Bank refused to pay out on PPI because I never paid any NI, I cancelled policy and sued. Solicitors said I could only claim up to date I cancelled and retrieved that but did not understand contract law so FOS awarded me full payout for after I cancelled. I hope this might help anyone. I am after solicitor now but look what I am up against, my latest email to the LSO.
Dear Mr Norton
Thank you for your letter dated 5 October 2011 received today the 7 October. It will be noted after I received this letter I telephoned your office to have sight of the final report you allege was sent to me on the 15 September 2011. Your office sent the final report by email shortly after my telephone call and although I am disappointed by your conclusion I will need to have someone go through your reasons to see if I take this further through the courts.
I have lived here over 30 years and in that time I can remember only ever having one letter lost in the post before becoming involved with Ombudsman. The FOS lost months when a letter was never sent to which they did apologise, the old LSO never sent a final report and you award me £50 because of this. I thank you for this however it is only because you finally got round to answering my three correspondences starting on the 15 July 2011 did I find out you sent the phantom final report. I will be making a formal complaint just for the hell of it to see if you award me another £50 for your own incompetence.

any what is your point? the public will never access cases as FOS due to the data protection act, you really want people to access your accounts, have you heard of fraud?
What is a LSO?
You are very lucky to have only lost 1 letter in post in 30 years. For 99% of the nation it would be significantly more.0 -

Its sounds like the FOS got it wrong. They're not the most efficient organisation in the world.
However they have apologised and given you £50. Surely thats what you were after when you complained? They're not made of money and tying up their time with more another complaint is going to slow things down further for other consumers who are struggling with long delays.
Sometimes its better to let things drop.0 -

The LSO is the Legal Services Ombudsman who looks at complaints with the legal profession.
I may not have worded my post well but my point is all judgements should be open to public access so as to be seen to be fair and just. Data protection can be overcome as in child cases naming persons a A,B,or c. How can anybody judge if they have been treated the same as a similar case.0 -
The FOS apologised but not the LSO. The LSO is funded by the legal professionals and the FOS is funded by the banks. When a solicitor or bank are incompetent they should pay. The government sets a time frame for these complaints to be dealt with, so should not the banks and solicitors pay more to these bodies if they have not enough staff. The more they are forced to pay towards the incompetence of their professions then one day we might get less complaints.Its sounds like the FOS got it wrong. They're not the most efficient organisation in the world.
