Accident but no claim now lost all no claims bonus

My son had an accident driving along a single track lane a few months back, he saw the third party coming and slowed down but the third party skidded and hit him head on. The insurers said it was 50/50 although we sent proof to our insurers of the TP skid marks on the road! So no claim was made. He has just received the cost of his renewal in which it has doubled and lost all his no claims (unprotected) which would have been 3 years this renewal. Can they take his no claims bonus away like that when a claim was never made?:mad:

They can do so whilst the file remains open.
If his insurer considers this a split liability, then they will be expecting a claim from the third party (or as has already been suggested, may have already had one and paid out to the third party)0 -
I had an accident this year (my fault) and they took 1 year off my no claims bonus, so I wouldn't have expected him to lose all 3 years even if the accident was his fault.

You were lucky!
The norm is that with unprotected NCD when you have a claim made against your policy which is your fault that no NCD is awarded for the year in which the claim is made, and you lose 2 years from any you held at the start of the policy year.0
