reclaiming when over 6yrs yrs

We have a loan taken out in 2003 which we are still paying,is it still possible to reclaim at all? Thanks

    Certainly is, my claim goes back to 2004 and have just paid it off 2 months ago. If you are still paying it, it should still be on record, go for it ;)

    Can you complain then yes, but can you claim perhaps not. Its not as clear cut as others have made out, it depends if the firm in question is under FOS jurisdiction for that time. If it is a high street bank then yes, but a few lenders were not and as FOS jurisdiction and FSA rules cant touch them so they may reject the complaint.

  • I've just posted this in the "success"" forum but due to the dates I thought you'd be interested in my claim.

    I decided to be a little cheeky and see if Halifax would pay back the PPI for a loan I took out in December 1999 paid off in January 2003.

    I completed their complaint form and posted it off. The next day I received a call from them to confirm the details and the lady from Halifax noted that the loan was a top-up to another loan I took out in 1997. She told me they would look at both loans.

    About a week later I received 4 letters from them. Two of the letters were about the loan from 1997 and two about the loan from 1999. All four stated they were investigating the claims and I would hear back from them within 16 weeks.

    I believe they are supposed to deal with complaints within 8 weeks but knowing they would (hopefully) have a huge backlog I felt I should be fair and allow them the 16 weeks.

    Well the 16 weeks expired on Thursday (6th October 2011). Knowing our postal system can be, at times, a little slow I again played the nice guy and decided to give them until Monday (10th October).

    However, yesterday I received two letters and to my amazement both letters contained a cheque for repayment of PPI.

    The outcome!!!

    Loan 1: taken out in August 1995 for £5,000 - repayment of PPI - £2,179.78
    Loan 2: taken out in December 1999 for £10,000 - repayment of PPI - £3,698.63
    Total PPI repayment - £5,878.41

    The interesting part to this story, both loans had been paid off more than 7 years ago. I simply explained that it was my belief that I had 7 years from the time I became aware they had mis-sold the PPI and that was only after the recent judicial ruling. So it's well worth looking at those older loans. You have nothing to lose in doing so.

    I also, in fairness, must say Halifax were incredibly fair, paid out exactly what I believe to be a fair payment and it was they who included the first loan I took out.
