Credit Card PPI

Hey Guys,

I hope someone can help. I am trying to reclaim my Credit Card PPI myself and am a little bit out of my depth...

I have a Halifax credit card and have been paying PPI. I have sent a letter to Halifax CC and asked for my terms and conditions (using MSE template) They have replied and sent me my terms and conditions (not the original though, they have said they will send it separately)

Anyway what do I do now - Wait until my orginal signed agreement arrives or move on to the next stage...

    Hi there

Just as long as you have your reasons to make a reclaim, and the account number, you do not require the above paperwork as such, especially if you know you were paying for ppi.

So from here I would with your mis selling reasons, complete the reclaim questionnaire as on step 3, send to the ones who sold you/set up your account, head office or complaints dept by signed for recorded delivery, and remember to keep a copy for yourself as well, good luck.

Thats a really interesting point Di, I have a Nationwide CC and the current T&C state that their PPI doesn't cover unemployment but I'm sure for years it was covered but how can you/I prove this?.

I was successful with claiming PPI back from Halifax for loan insurance but I'm not 100% sure the Nationwide credit card PPI ever included unemployment cover.I've had the cc for about 10 years or more and they change the T&C all the time.

Is it best to write and ask for the original T&C ? if they still have copies of them

    Hi there

As everyones reasons differ, as some may have known they were paying for ppi because for example they remembered being told they had to take it out to be accepted for the loan etc, so they were more or less being pressurised.
In this case the copy of the agreement is not then required for a reclaim as such, but depending on the reasons and if not sure if PPI was taken out or not, then maybe it will be a good idea to request for a copy of the Agreement T&C's.

They should still hold data for at least the last 6 years of any insurance, even if they no longer hold the actual agreement on a settled account.

For even more information required, then that would be a Subject Access Request (SAR), they must comply to this by 40 calendar days, and you enclose the one off payment of £10 by cheque or postal order.
Full SAR template letter below if required, but this is of course optional if you want to try to dig for more details in regards of the insurance.

It can sometimes be an issue with them on a settled account, when requesting for a copy of the agreement, where they may come back and state they no longer hold this actual copy as such, but if you want to do this, then write and ask them to supply a copy by 12 days and enclose £1 cheque or postal order.

Going back to the SAR, where some will only send data going back to the last 6 years, some will hold data going back for even longer.;)
