Advice please - being properly done over :-(

I am a landlord, not a buy to let, this is my only house which is in Manchester and i live elsewhere in the country in a married quarter because my husband is in the forces and I am 8 months pregnant and at a loss at how to resolve the mess!!

I have a married couple in my house. They split up and he stayed in the house. He stopped paying the rent, i eventually got him evicted and he had trashed the house to the point of needing to have walls repainted, doors rehung, and all new carpets - there had even been dog poo on the floor of one of the bedrooms. In all i lost out by £6k.

Had to pay to search for him, took him to court, won the maximum £5k i could take him to court for and then had to go for an attachment of earnings - this is now 2 years into it. Yesterday i got an email saying the Attachment of Earnings people had been informed that he had left employment and were sending my case back to the court. And they will write to the ex tenant to ask for up to date details!!

Really!! What's the point in that, he's been running from this for 2 years, he's hardly going to turn round and respond to something now. But i've come this far so there's no point giving up now.

What can i do - any advice. I'm just a normal person who needed to rent their house out, i'm not a big nasty landlord trying to make a profit!! Please help

    The ex T *has* to respond to enquiries from the Court - that AoE order does not simply cease to exist because he has left his place of employment and the ex-T can be fined by the court or even imprisoned if he doesn't provide the information required.

    However, if he is now out of work or on a very low income you have to face the fact that you are unlikely to get your money back or if you do it will be at a very low rate of repayment. When letting a property out, you are effectively running a business and sometimes businesses have to write off their losses, learn from the experience and move forward.

    Funnily enough most LLs are "just normal people" and making profit is not a crime.

    If you are still letting the property, hopefully you will have vetted your current Ts properly. If your OH is away a lot and you are soon due to give birth your best bet is probably to seek out a reliable Letting Agent.

    If your OH is in the forces, perhaps some angry squaddies rolling him around in a dustbin lined with carpet gripper rods, finished off with lashings of blowtorch to the feet washed down with a waterboarding in the stream right by a dirty great sewer outlet might focus his mind?

    Speak to an accountant if you haven't already and see what advice they offer about your finances. Did you carry over a loss at the time?

    Can you not chase the wife also as she was joint tennant ?

    The wife may not necessarily have been on the tenancy agreement as having joint and several liability - she could simply have been a permitted occupier, especially if the husband was the sole earner at the time they took the tenancy on.
