Washing Machine faulty Main Board 15 months - my rights?

    My suggested changes - the latter one being important; you WANT it to be an inherent fault.

    What specifically does the engineer report say? Does it allude to the fault being inherent?

    Note: Argos also have the option to offer you a refund of the purchase price, less a reasonable amount for usage. If they go this route I'd guess they'd offer you 60% or so of the purchase price.

    The report reads:

    Job Description: To check machine and advise customer on a main board fault which is a danger. Machine turns on when not in use.
    Cost to repair approx £x amount
    Information Only

    Signed by the visiting engineer

    To be frank, I would make it shorter. A couple of reasons for this: Firstly, being so long is unneccessary - it probably won't be read in its entirety, just the main points and then acted on from those. Argos don't need to know who you spoke to and when. By all means, keep this info handy in case you meet with resistance, but for this letter, not really relevant. Secondly, Argos don't really need to have the law or report explained to them at great length, they will know this. Keep it short and sweet, and in true MSE-style, save your printer ink!!

    Maybe something like:
    [Your address details, phone number and order number here]

    Dear Argos,

    I called last week regarding the failure of my washing machine purchased on 7th May 2010 (proof of purchase enclosed). As advised by the customer service team, I have arranged for an independent report into the fault, which is that the machine turns itself on, even when it has been turned off.

    As you will see from the enclosed report, the mainboard has failed prematurely due to poor manufacturing. I would like to request a remedy for this under the Sale of Goods Act. I would also request that you refund me the cost of the report, which was £48.

    I would be grateful if you would reply within 5 working days.

    don't finish sentences with ! either - its unnecessary and detracts from the actual point of the letter. Short, descriptive and to the point is the order of the day...

    if you do have to go ahead as is...
    This letter has been sent recorded delivery – I ask that notification is made to myself of receipt of this latter within 5 working days and then a further decision on action to be taken also to be made within 10 working days from receipt of letter.
