    Sounds like they are leavng it very late, maybe hoping you will duck out. Ignoring the judge's advice doesn't sound like a smart plan . One does hear of settlements on the court steps but others will no doubt say if this does indeed happen in ET cases and how often.

    Is it a big or small company? Do you have a clear idea of what you'd accept?

    Whatever, stick to your guns and see it through - and good luck.
