VOID car Insurance

What happens to the 3rd party if your insurance is void because you havnt declared points/prev claims or modifications?
Sumone crashed into my bfs van.. they had insurance but they had a named driver on it and hadnt declared their points because they didnt know about them!..
Will they still pay to fix my bfs van? (it was parked BTW so hes not to blame)
Can the car driver get done with having no insurance?

The third party insurers will have to indemnify your boyfriend. They can then seek to recover their outlay from the third party.0 -

The insurance havnt actually told us this.. the other person involved told us I thikn to prepare us incase we didnt get the van fixed.. they havnt said anything to their insurance yet.. but hav processed the claim..
I thought they would be better of jst telling their insurance company now.. rather than the company finding out any way but they were terrified of being charged by police.. and said it was a genuine mistake.
theres 3k of damage so they wouldnt be able to pay.. hence the reason i wanted to make sure sumone would pay.0 -
It is down to the insurance company how they want to deal with it.
Under the Road Traffic Act they are liable if there is a current certificate of insurance held by the TP. This is only however if the TP themselves cannot afford to pay for the claim.
Many insurance companies will handle the claim from the outset and then seek to recover their money from the driver of the vehicle at the time of the incident.
Some insurers however deal with things only as the law requires which means the TP themselves handle the claim, you have to get a judgement against them and then go back to court a second time when the TP fails to pay to get the judgement put into default and obtain a judgement against the insurer themselves.
It probably worth noting that there is a limit of £250,000 (if memory is correct) for property damage for an RTA insurer (but bodily injury is unlimited)All posts made are simply my own opinions and are neither professional advice nor the opinions of my employers
