CEL / Newlyn

Hello, i am new to this site so please bear with me.

I have been following all the good advice people have given with regards to ignoring letters from CEL and Newlyn but had a query about a letter I have recently received.
Te last letter we had was to say the details were being passed back and this was the last opportunity to pay. Then today Newlyn have sent a letter to my house addressed to “The Occupier”. The letter says the following

We have been instructed to trace the previous occupier of your property, NAME and would greatly appreciate your assistance in this matter. Could you please take the time to complete the form below so we can save you further intrusion. All information will be treated in the strictest confidence

The letter then goes on to ask

Your Name
Tel number
Date you moved into the property
Your Council tax reference number
Have you purchased the property, if yes your solicitors name/address
Do you rent the property, if yes your landlords name/address
Forwarding address for previous occupant

Should i be worried or is this another of their attempts to get hold of people and should I expect them to stop contacting me or is this them proceeding further. I am slightly worried :(

I had one of these today too, new scare tactic I imagine. I wonder how legal these are, they make it sound like it's an official debt from the council by putting council ref number etc. I binned it like everything else I get from them.

They have no authority to ask you anything. You do not need to tell them jack!!!!!

Add it to your ignore list! Newlyn are well known for exaggerating their powers, which basically are nil!

Newlyn do have bailiffs and do enforce proper unpaid PCN's and they have a habit of trying to mislead people into thinking they have powers to enforce mickey mouse parking charges. They have no power at all beyond asking you to pay!

Fishing, if they phone say that you cannot give the data out because of the data protection act. If you are up for stringing them along look here for suggestions. https://forums.moneysavingexpert.com/discussion/741653

  • Thanks for all the info guys,

Luckily i have never contacted them after reading on here so they don’t have a number for me i don’t think. i shall ignore it like the other letters

Would they ever turn up to a person’s residence over a ticket from CEL?

Very much doubt it, if they did they still have no authority, just like a cold caller, feed them to the dog!!:D

    Hi guys.
I have a problem with them as well (about some unpaid council tax[which I'm not even aware of] but the dates match(more than 5 years ago)).
Have received numerous letters from them, and I so far have ignored them (taking advice from online forums).
The latest one is about bailiffs coming to visit the area soon.
My only worry is if they REALLY turn-up. (Or some other bailiffs booked from them).

But this is not the same situation as on this thread.

'Newlyn acting as a bailiff' for Council tax have some powers; a situation completely different from 'Newlyn acting as a debt collector' (toothless waste of time).

In your case, I think there's a chance that the debt may become statute barred after 6 years (but not sure as the Council/Newlyn have been writing to you...). It may be worth your while posting about this on the Bailiffs section of the forum on Consumer Action Group and hope that tomtubby gives you some advice (a bailiff who is known as Herbie on here but is more often to be found on CAG forums).

If you get an urgent issue, tell your family, DO NOT pay the bailiff, do not let the bailiff in. You may want to pay a tenner and register for specialised bailiff fees/procedures advice from bailiffadviceonline, so you know where you stand, what they can and cannot do, and what they can and cannot charge.

    HTH
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If bailiffs do call you could do as Coupon-mad suggests, as The owner of Bailiffadviceonline is extremely clued up as to what they can and cannot do, and also post up on the bailiff forums on CAG
