News - Bankrupt given eight-month prison sentence for perjury - employment status

The investigation showed that after being made bankrupt in December 2009 Mr ******, aged 58 of Ledbury, Herefordshire lied to the Official Receiver by claiming that he was unemployed when in fact he was working as a chauffeur.

    unfortunately you only ever get a few details in these cases, it would be interesting to know how it was discovered that he was working

    Unusual one or an extreme example, which is probably why it made the NDS. i.e. highlighted to make a public point.

    Fibbing to the OR/courts, or not disclosing information where you have a legal duty to do so, can have very serious consequences.

    I don't think people are charged with perjury very often. There is another offence of making a material omission in statements to the OR which is charged more often. So I think when the courts see it they take it very seriously.

    Even so I feel like 8 months is quite high. There's no mention of him having previous convictions or that he was stashing cash away.

    I think it's pretty implicit that he was stashing cash away. If he wasn't then why hide the fact that he was working?

    I'm sure there's a degree of example making here.

    well, depending on outgoings etc, you might expect an income like that to generate an IPA of about £500pm, so over 3 years that might be £18,000 that may have been put beyond the bankruptcy, compare that to other things, so for instance if you used fraud to obtain £18,000 of loans what would you get, or perhaps £18,000 of benefit fraud what would you get for that.

    Just speculation, but just trying to compare it
