Buyer taken over 45 days to reject item

Hi i need some advise

I sold an item on ebay back on 10th Aug, the buyer never collected the item so it was returned. Despite me contacting her asking what she wanted to do with the item she has only just got back in touch now saying she doesn't want it. I said i would refund her but as its over 45 days i can't cancel the transaction. Where do i stand?

    You should have 60 days in which to refund the buyer via paypal, unfortunately though you have lost your FVFs on this one.

    Thanks i did state on my listing that i only ship within the UK, she bought the item despite living abroad so i sent it to her. I'm pretty gutted that i have lost my FVF's. Can she make a claim as its been 7 weeks since she bought the item?

    What kind of claim do you mean?
    Are you considering not refunding her?

    Just wanted to check things out as she had taken 7 weeks to say she didn't want the item.

    You should be able to refund through the original Paypal transaction.

    I would refund minus postage and fees. Unless your a business? Check selling regs...

    A refund must include the full original price and full original p&p

    You seem to be suggesting that the buyer should be penalised for the time taken? That's the buyer's right.

    And the OP has the item to resell.

    It certainly is a loophole though, that a buyer can be refunded up to 60 days after the transaction, yet the transaction cannot be cancelled through no fault of the seller.

    Forgive me if I'm wrong OP, but I got the distinct impression that you were considering not refunding because your buyer could not open a case. However your buyer would institute chargeback instead.

    I wonder if contacting eBay Customer Services to explain and appeal for your fees back may be worth a shot, OP? You've got the message from your buyer to confirm they no longer want the item and you've nothing to lose at this stage.

    The buyer can't always start a chargeback. I couldn't, as I always have a paypal balance so pay with that.
    Nor is it the buyer's right to take as long as they like. People are fond of quoting ebay rules, they have gone past that.
    A dilemma for the OP. Should she be out of pocket?

    I would ask the buyer if she would accept a refund, minus postage costs and ebay fees due to the length of time she has taken to sort the matter.

    7 weeks is just not acceptable to ignore the seller.

    If a seller didn't post for 7 weeks everyone would jump on her.
