GOODLIFE_NOW wrote: »Tigerfeet - So wong again the OR has advised my secure debt is a priority debt and will be part of essential exp /inc ome , for my IPA if i get one .
i did get advise before BR and did not rely on media forums such as this one , i am obviosuly so squeaky or clever ive not had any questions pre discharge,. lol
Is the rent of a suitable property for your needs less or the same as than your mortgage payments + loan repayments. That would explain why the OR thinks it cheaper to allow you to remain in your home and pay the secured loan as well as mortgage.
Of course being on benefits automatically means no IPA. If you do find work and are reassessed then the OR will look at your expenditure again.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. im not usually one for the spelling police, but since you have used it many times on this thread, please look up the difference between advice and adviseHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.0 -
also since you are not so happy with the information provided perhaps you would care to restate your question more precisely ending it with a question mark so it can be identified what you are actually asking.Hi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

If there is negative equity in 3 years time you will get the beneficial interest revested to you.
If at a time after that the negative equity disappears the secured loan company could repossess. At which point your credit will again be hammered by a repossession noted.
Better to decide soon whether your aim is to keep your home or not.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. maybe you would like to evidence your advise - esp into nino and hmrc contributions .
as well as showing secure debts are non priority exp for an IpA.
i would hate for you to give incorrect advise on such a important area such as bankruptcy esp to the working .
I'll show you mine if you show me yours! Oops, I already made myself perfectly clear, your turn. Where did you get your 'facts' on tax and NI from? (You pay NI on your wages btw, a NINO is a National Insurance number).
I never commented on secure debts and IPA so have no need to provide evidence on that. When I joined, I needed a name. The forum members gave one to me...I am INAN

The evidence on secure debts being non priority has already been given to you:31.7.89 Payments to additional secured creditors
(Amended April 2011)
Where there are additional secondary secured creditors the official receiver should take into account all payments to be made. Where there is no equity available to secondary charge holders, the official receiver should not include any payment to these creditors in an income payments calculation as there is no enforcement action that can be taken in respect of these debts as the asset is already fully charged, and as, in effect, the secondary charge holder is an unsecured creditor, any payment to it could be considered to contravene the provisions of section 285(3) of the Insolvency Act 1986.I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
