ESA Appeal - Date 27th Oct

    hi there,

    I have recently been to an appeal helping a family member, my advice would be to take ALL the evidence you can, try not to overload them to much on on the actual day tho. We sent all our new and updated paperwork to the Tribunal service and copied in the DWP (the tribunal service will send them a copy as well) about 2 weeks before the date to give them a chance to look at it. The clerk did ask on the day if we had anything to add but we didn't by then.

    Are you going with your husband on the day? I wouldn't worry to much about putting a letter in if you are as you will be given an opportunity to tell them what your day to day life is like etc, however, they will want most of what is said to come from your hubby so make sure he is prepared to answer a lot of questions about his conditions x good luck - hope that helped a bit for you :)

    Hi all I just wanted to update you all on our appeal today.

    I was feeling sick as a pig about today. We arrived and everyone was so lovely. The security guard helped us into the waiting room and the clerk talked us through what would happen. Our advisor turned up and went through our paperwork and then we were in.

    The judge and doctor was very lovely and he asked lots of questions to OH with a little bit of help from me.

    After 20 minutes they sent us out so they could delibrate and then after 5 minutes they called us in and said OH scored 18 points :-D

    They have put him in the WRAG. We are now able to move forward and concentrate on his treatment and not worry about if we can eat next week. They will back date his money and this will be going straight to an emergency fund.

    Thank you all who have given me advice and to those who are waiting to go to their tribunal ... be confident and they are not all monsters lol

    Great news.. well done. The DWP should swiftly get the decision and hopefully resolve the monies soon.

    Maybe it is worth saying that you might want to see if your adviser thinks it worth asking for a statement of reasons for the decision from the tribunal judge... for future reference... if the results slip doesn't give sufficient detail (I haven't seen a results slip for ESA tribunal.. only DLA.. but it would help to know what descriptors they felt applied that made up the 18 points). As my old boss used to say 'it's sometimes easier to return down a path you've marked on the map'.

    Hi Muttley :-) The slip we was given has a full description of the 2 areas he was awarded points.

    They did say they would send a full report so that will be interesting to read x
