Gggrrrr this is getting beyond a joke

Mr Postman delievered an unwanted surprise for me this morning!

CLAIMS COMPANY demanding their payment :mad:

I told them right at the start that I wouldnt be able to pay them until I recieved any REFUND from PPI, they have said this is the last invoice they will send and if no payment within 7 days they will issue a statutory demand to recover the costs!

They advised that I strongly suggest that I seek legal advice to clarify the onsequnces of ignoring a statutory demand

Advice please .......................

    are they a no win no fee? if not and they require a fee up front then you need to pay it.

    Debtline and the
    CLAIMS COMPANY haven't got a leg to stand on
    As the debt is less than £750, he said to take the letter as and idle threat !

    You should really call or write to them to discuss the bill, to make sure they know you haven't yet been paid by your lender.

    If they're a decent business they should realise that as a 'no-win, no fee' organisation they shouldn't expect payment until the refund is in the consumers account. They haven't 'won' the money until the payment has been made.

    They should also know that there's no point hounding you for money that you don't have. Even from a purely business point of view, it would be better for them to wait until the refund has arrived before chasing up the invoice.

    If they don't believe you've not got the money then tell them to check with the lender, who will confirm payment hasn't been issued.

    That said, a lot of CMC's aren't decent businesses, so tread carefully. I know invoicing early is their mistake and it may be annoying having to go back to them, however as long as you tell them you'll settle their bill in due course I can't see why they would take further action. It wouldn't make any sense for them to spend money aggressively pursuing the bill when you are going to pay up soon anyway.
