  • It is indeed down to me to prove that. I am having the console assessed as soon as i can.

    With regards to it being second hand, Consumer direct have advised that that makes no difference. The same rules apply. Their advise was to pursue as far as i can and go down the small claims route if needed.

    "Good Morning.
    In your response to this email, PLEASE ADDRESS MY COMMENTS AND NOT JUST STATE YOUR WARRANTY PERIOD!
    I am not referring to a repair or replacement under the warranty. I am requesting this under the 'Sale of Goods Act'. I have been on the phone to consumer direct, who have advised that I take this to the small claims court if I do not get a "satisfactory and lasting remedy" from yourselves.
    Under the Sale of Goods Act, if I can prove that the error with my console was not due to accidental damage or wear and tear and was in fact due to failure of a component which should have lasted longer than 15 months, then you as the retailer that sold the product are obliged to provide repair or replacement free of charge. If you take the time to research this particular piece of legislation and other cases of playstations that suffer this error outside of warranty, then you will see that with proof of purchase and proof of the cause of the error (as stated above), you have no choice but to come to satisfactory agreement that provides a "lasting remedy".
    I am extremely disappointed with your replies to date. How do you possibly come to the conclusion that an unhappy customer that has been sold a faulty item would be appeased by those two emails. That is appalling customer service.
    I will be taking this to a small claims court if I you do not meet the regulations set out for all retailers.
    I sincerely hope that the next response I receive will indicate that you have read and taken on board my comments and not just stated you warranty period AGAIN.

    how old was the PS3 when you bought it second hand?
  • Unfortunately I don't know. It would greatly help if I could find that out somehow. Do you think there might be a way from the serial number? or by contacting SONY?

    Sony stated at launch that the PS3 should last 10 years!

    I think they meant the technology would be good for 10 years, not each individual console.

    Anyway Sony has been selling poorly made PS3's for years and years and charge £140 for a replacement every time their console fails. If mine breaks one more time they can kiss goodbye to another customer.
  • Yeah, thats why i didn't bother mentioning it in my email. HMV have a 120gb slim pre owned for £130 at the moment. was just going to get that, handed them my card and they went, Oh, hang on, sorry this ones broken so we cant sell it to you!

    CEX's responses just make me so mad, they dont address anything you actually say in the email, just copy and paste a one-liner about their warranty period.

    Our PS3 broke too after about 18 months or so. Wouldn't play any DVD's or games.
    We contacted the company we bought it from Gamestation or something like that and sent them a letter i found on the internet stating something about expecting eletrical items to last a certain time period yadadada.

    Luckily for us they fixed it for free! by sending it directly to Sony.

    We then sold it on and bought a new slim PS3 :/
  • Sorry, but you have no chance of winning. It was 2nd hand, and you had a 12 month warranty which has expired.

    As for SOGA, yes it should last more than 15 months. But is HAS lasted more than that. It's 2nd hand, so could have had years and years of usage.


    Just spoken to Consumer direct again as you had me doubting! they said that unless the item is clearly marked as having a fault then the same rules apply. They said that it shouldn't make any difference that it's from CEX and second hand to if it were say HMV and brand new.

    thing is...Sony are actually known to be rigid on the original warranty - CEX take the hit on the used warranty, not Sony - I wish you a great deal of luck, you're going to need it imo...
  • A couple of tips that i've come across for anyone in the same position...

    There is a company called Retra - Radio, Electrical and Televison Retailer's Association, that can identify when an item was bought by the serial number. Easily found on google.

    The direct.gov website has letter templates for this exact situation, quoting all necessary SOGA bits and pieces.

    Consumer Direct is also very helpful.
