Help needed with tv and Comet

I got a replacement tv 3 and a half years ago due to my Sony tv going faulty, my replacement tv was a samsung 40" and has been fine up until a few weeks ago when a shadow has started to appear in the bottom right hand corner I rang comet due to this fault and my extended warranty has ran out august this year :( I believe that my tv is manufacturers fault and and should have this replaced or repaired by comet. Now I've had the engineer out that cost me £69 who agrees with me it is faulty but will not do anything because it is 3 and a half years old and want to charge me £565 to fix it any help on this would be greatly appreciated

    See the sticky thread at the top of the forum.

    You would need to prove the TV was inherently faulty and then claim from the retailer under the Sale of Goods Act. They can choose to offer a repair, replacement or partial refund.

    The best way to do this is to obtain an engineers report stating that the TV was inherently faulty (note that a fault due to wear and tear is not covered ).

    I had a simular issue with a HD vid cam from comet. After getting fed up with them blagging me, i had an independent inspection caried out on the Camera. It turned out to be somthing to do with the processor burning out after only 19 month of resonalble use . Hardly missue..

    The only route i could find to make them reconsider was EU Directive (1999/44/EC) Im not sure if this directive is applicable in your case but well worth a read through.

    Why use the eu directive when the SOGA incorporates it anyway and actually has more scope?

    Because at the time, the EU Directive was what was my Euro MP recommended.

  • Hi guys thanks for ur advice, I took my tv to a samsung specialist Martin Dawes and rang samsung to see if there was anything they could do and samsung got he report to say it was faulty and they've offered me a partial refund of £400 I paid £800 for it 3 years ago and thinks that the offer is very fair what u think guys.
