    The problem is (from what you've said) your father didn't put anything about giving the money to your eldest daughter in writing. The whole point of a will is to say how the deceased wants their assets to be divided and as far as that document said the money is yours.

    So it comes down to what a legal document says was the wish of your late father vs what you say his wishes were.

    You will be able to survive if your low income benefits are taken away because you have capital from your father's will which you can use.

    Its only the word of your father who thought it would be a nice idea to buy his grandaughter a flat, and it is in an ideal world. Did you not reply but father rewrite your will as I am on benefit and won't be able to afford to live if I have to pay my council tax? If not then its actually your choice to buy the flat. You must have inherited a fair whack to buy a flat and £16,000 is the limit for council tax benefit anyway. I take it you don't get housing benefit.

    The savings won't affect your tax credits so you only have to pay your council tax. Of course you will then have to pay council tax on the empty property. Rent the property out and make some money remembering that other income will affect your tax credits.
