ARNOLD CLARK - please help

Please could someone offer some advice as dont know what else to do.

We purchased a secondhand lexus in Feb and have returned the car on 4 occasions the final time was on 4 August and gave them every opportunity to fix the car as we had also purchased extended 2 year warranty.

Arnold Clark then advised us on 29 August the was uneconomical to repair but to date and despite asking for a full report we still do not know what is wrong with our car. They had initially said they would sort out a refund and advised us to cancel our insurance and also returned our car tax to us. this was completed on 31 August.

4 weeks later at a recent meeting have now said they will be (and have started) repairing the car with parts from a written off Lexus despite having purchased an extended warranty which we believed would be new parts.

We have previously advised them in writing that we believe we have given them every opportunity to either repair or provide a replacement but since they have not achieved this in a timely manner we are seeking a full refund under the sale of goods act but they are insisting they are repairing the car despite our non agreement.

we as you can imagine are not happy with this and don't know what to do next. We had intended to get an independent report on the car but according to them they have already started repairs (not approved or agree by us).

Any advice or guidance would be greatly appreciated as we really cant afford to secure a solicitor. (but suspect we might need to!)

    Check your household/motor/breakdown insurance, you may have legal cover on that.

    Have you formally rejected the vehicle, in writing to them?

    I've just ended a 5 month ordeal with that company. Their customer service and quality of workmanship is a disgrace.

    What exactly is wrong with the car?
  • Have written to them formally requesting a a refund under the sales of goods Act as car not fit for purpose, of reasonable quality etc on 29 August. They have not replied in writing and to be honest we have had significant difficulty in getting any communication from them as they don't return any calls and appear to be avoiding us (typical Arnold Clark). thanks - Will be checking our household insurance for legal cover etc.

    The problem is they initially said there was silicon in the engine but at the meeting when we said this they claimed they did not know what was wrong with the car hence why we asked for a written report, which they have never provided.

    At the meeting they also claimed it was uneconomical to repair despite having taken out their warranty. They now say 4 weeks later they are replacing the fuel system from a written off car but we still don't know what is wrong with OUR car and have again put in writing our request for our money back and evidenced our communications with them especially as we have not approved any repairs but they have done this anyway. Did you have a successful outcome from you issues?

    Hi Sarah, sorry its taken so long to reply.

    Eventually I had my car sorted, wasn't 100 % happy but happy enough to end the battle I had with them.
