Car insurance claim help me!............

Right big problem was wondering if anyone could help.....

i was in a 3 car shunt back in may 2006, i was at the front of the 3 cars and obviously had no fault in the accident at all. To cut a long story short my insurance company gave me a solicitor to deal with the claim, i had to claim my damages off the guy at the very back of the 3 car shunt as he "caused the accident", and not the woman who was behind me who actually physically hit my car. The trouble is the guy at the very back of the accident did a runner! C@nt!
Luckily the woman behind me got his number plate (i didn't)

straight forward you think!....... Nope, the guy denied involvement in the accident when a claim was made against him.

Ok so solicitor goes back to woman and eventually gets hold of her and she agrees to fill in a witness form saying it was definately him. Unfortunately she never filled in this form and is no longer answering her phone, thus solicitor h as said there is no more he can do and wants to give up.....

now this is a pain as im now about £1k out of pocket for a fooked up car and had to buy myself another car to get around in (ok it only cost £65 to buy, but it cost another £180 to get through MOT and is almost dead)

anyone had any similar problems and/or know what to do?

One thing i do have is the guy who denied involvement address, im very tempted to go round there and see if it is the same guy, and if it is smash the f*ck out of him

sorry for the rant but as you can probably appreciate im annoyed!

    As your solicitor about the untraced driver agreement with the MIB - it has been too many years since my claims days to remember the differences between the untraced and uninsured driver agreements.

  • but he's not untraced or uninsured, just denying involvement in the accident!

    Tell your solicitor to commence procedings. If they will not, complain to your insurer who appointed them.

    Normally the commencement of legal procedings means a court summons lands on the chaps door mat. This normally persuades people to stop playing silly beggars.

    If it is purely from a registration then it is possible that it isnt the right person... have the police prosecuted for failing to stop?
