Advice on complaint to Argos about Cooker

I have just bought a cooker from Argos in their sale. The grill was described as being combined with a top oven so I expected two ovens but after unpacking it and chucking my old cooker outdoors I discovered that there was no top oven, just a grill. I complained to Argos about this and asked what their solution would be. They replied by simply asking me to accept their apologies! I have worded an answer to this which highlights an additional problem with the cooker. I'd just like to know if I'm missing anything out here, or if anyone can think of a better way to word the complaint or what to ask for. ideally I'd like a replacement with a top oven so that's all I've asked for, for now. The body of my reply follows, any advice much appreciated:

"Your reply to my complaint is unsatisfactory. According to UK law electrical goods must be; of satisfactory quality, fit for their purpose and as described. Your product does not meet these requirements. In addition to the product being misdescribed I have now discovered that there is also a fault with the fan in the bottom oven; it makes a loud banging noise and is obviously not in full working order.

In accordance with my rights I would like to like to request a replacement cooker that complies with the description given, the main specifications being; Fan assisted main oven, Grill combined with top oven, 4 hotplates, Energy Class A.

    Well you can but ask for them to replace it with similar described item,as its not as described,but dont think you can demand they do it in law.You could report them for he breach IMHO

    what the courst would look at is the description of the oven, and what a reasonable person would believe it to be (and whether at all it is a description or a representation). Could you post a link to the item at all?

    Why not just return it and find another?!?

    I'm sure Argos won't give you any other option and IMHO going to court is rediculous!

  • I certainly don't want to go to court but I would just like to have what I expected, or else a little compensation, it's a hassle having to connect and disconnect the cooker several times. I could look for another one but it would probably be rather more expensive and I do think they have some sort of obligation when they have printed a misleading ad.

    I have to admit it does read as though the grill part is also an oven,

    * Grill:

    * Electric grill.

    * Combined with top oven.


    * Full width variable.

    * Grill pan with detachable handle.

    then further down the page;

    # BOTTOM OVEN TECHNICAL SPECIFICATION:

    # Energy class A.

    # Energy consumption 0.79kWh.

    # Net cavity volume 55litres.

    # Medium.


    I still think the most you are likely to get from argos is a £10 voucher and possibly the option to return the oven for a different one.

    That sentence alone, to me, implies two ovens.

    I would print out that descriptive page, if I were you, in case it changes in the near future and you need proof of description.
    Anything I post here is purely my own personal opinion. As such it may be wrong, poorly worded or written very tongue-in-cheek. Please therefore treat it the same way you should treat anything you read on the internet from an unknown person - with a healthy pinch of salt and scepticism!

    I have printed the ad out and am surprised they're still running it given that they have apologised about it. Looks like I might end up just returning the cooker, but will wait and see what they say.

    the item is most definitely meant to have two separate ovens etc.

    On pricerunner this is described as having 2 ovens.If they had misdescribed i would feel the same as you.
