Solicitor failed to Register property

Our solicitor failed to register our property with the Land Registry.
Property purchased in 1979.
Question is, do we have a claim against them.
We still have copies of letters etc.
Cheers,
Len.

has it been rectified now, and have you incurred any actual (not theoretical) cold, hard cash losses?

Did they fail to register a purchase in an area of compulsory registration or did they fail to follow an instruction from you for voluntary registration?

Registration of land ownership hasn't always been compulsory. You don't say where you are in the country, but registering a property became a requirement on different dates in different places. There are plenty of areas where registration wouldn't have been a requirement in 1979. In some areas it didn't come in until 1990. See this page, but note what the page states i.e. "compulsory registration has generally been introduced at district authority level. Because of boundary changes and many reorganisations of local government, it is not always easy to find out when a particular area became compulsory."
  • Did some more checking, here in Cornwall, and it transpires that registry became compulsory in 1988.
I wonder if they will allow me toregister at the 1979 price!
    Thanks for the replies folks.
    Regards,
    Len.

No. Voluntary registration involves a fee based on current value. BUT there is a discount of 25%.

You're talking about a couple of hundred pounds (unless you own a a country estate worth millions in which case, sell a corner off!).

OP didn't understand the situation and asked for help. Others posted helpful advice to OP.

You then came along and saw a chance to boost you pathetic little ego by posting one of your nasty little put downs.

I know which post in this thread I consider an error!
