    The replies are amusing, but don't answer the question.

    Since she is already in the UK, you should not apply for a spousal (marriage) visa. Rather, once you are married she can apply for Further Leave to Remain (FLR). This lasts a year, after which she can apply for Indefinite Leave to Remain (ILR).

    The forms, and instructions on how to complete them and what supporting evidence you need to submit with them, are available on line (google will find them for you). Read the instructions very carefully, since you have to do exactly what they say. If you forget one single silly piece of paper, your application will be declined and you will then need to pay the stiff fee all over again.

    I suggest that you now also read the requirements for ILR, since in order to apply for this you need to submit documents and letters dating back a long time, and it is never too soon to start saving the necessary paperwork.

    I believe that as you are marrying a person from outside the EEA you require permission to marry from the Home Office. Once you have obtained this you can then marry before she can apply for leave to remain as a spouse.

    It costs quite a bit of money but there is no need to get a solicitor involved. Apply in person as it is a lot quicker and the UKBA staff will go through all of the forms with you to make sure that you have everything. Just don't bother going along on the 30th November...

    I would suggest that if you are now living together that you should not be entitled to pension credit. Even if your partner does not have the right to remain in this country all their income and savings affect means tested benefit entitlement.
