Am I being unreasonable?

I bought a brand new boxed TV from Tesco HomePlus on the 23rd of August for my son's birthday. I only opened it yesterday and found that it had obviously been an ex-display model. I rang to ask if I could get it swapped and was told by custiomer services that I "had 28 days to check the TV over and get it swapped if there was a problem". I explained that it was obviously a used TV set but the guy in the phone had got to the part in his book that said "From now on say it's out of the 28 day returns period no matter what they ask"
The box wasn't marked as ex-display and as far as I was aware I was purchasing a brand new piece of equipment. My son's birthday is in November (they had a 20% off 24" and below TVs) so didn't see any real urgency to check it out and if there had been a mechanical problem then it was covered by warranty anyway. I certainly wasn't expecting a marked frame and a whole load of fingerprints on the screen.
I emailed customer services but have not had a reply yet.

Possibly yes, after this amount of time you would be deemed to have accepted the goods. But it is still worth persuing it via their CS department...0
