Hi there,
I ordered a gift (inflatable kayak) online and gave the wrong address by one house number for delivery. Ive just found out from the online store that the neighbours received the package and signed for it last week even though its under my girlfriends name....
Noone answering the door! Anyone any idea legally where I stand. I got the address wrong but they signed for a package that wasn't for them....
Any help and ideas much appreciated!
Thanks
Niall

It's a difficult one. Technically the company has fulfilled their side of the contract fully. Your issue is now with the neighbours who have possibly purloined your goods. They're not entitled to keep your goods. Doing so is theft. However, proving they have them might be more awkward. How long have you been trying to contact them? Let's hope they've just gone away or something.
But... if they haven't and you either can't ever get hold of them, or you do and they deny taking receipt, I suggest you write a letter stating that the courier has confirmed that the package was delivered there and signed for, and you want them to return your inflatable kayak (preferably uninflated).
Your ultimate redress would be to take them to small claims court I guess. Do you think you have enough proof?"Growth for growth's sake is the ideology of the cancer cell" - Edward Abbey.0 -
Hi fluffnutter,
Thanks for your suggestions. Only found out today that the kayak had gone to the wrong address, spoke to the online shop briefly to confirm that but they are now closed. My girlfriend has tried getting hold of them but with no joy so far... as you say lets hope they're away or out for the evening.
Can definitely get proof from the courier as the online store had a copy of the "signed for" signature on their screen earlier so that could help out. Thanks for the info on the fact that they have ,in effect, stolen my kayak... wasn't sure if that was the case or not and if they were entitled to keep it.
Will keep you posted on any developments and whether it gets returned inflated
Many thanks

They've only stolen it if they don't intend to return it (which you don't know yet). But, yes, they're not entitled to keep it."Growth for growth's sake is the ideology of the cancer cell" - Edward Abbey.0 -

Not a good sign.
OP you have to be very firm with neighbours in knowing they have your Kayak but not negative. i.e. "thank you for signing for my Kayak the other day- hope it wasn't too much trouble - I'll pick it up now." If they deny having it, say you know they signed for it and act puzzled by their denial (ie. you don't understand how they can deny it). If they keep denying go to police and write a letter.0
