Hi Folks,
A collegue of mine has got himself into a situation I wondered if anyone could offer advice.
He had a collision when turning right at traffic lights: moved forward, couldn't turn because of oncoming traffic, lights went to red, he made the turn to get out of the junction, but a car came 'out of nowhere' from the other side of the junction (their lights also on red) and they collided.
The police attended the scene and my collegue was issued with a producer notice and was breathalised. After he'd produced his licence etc he was told it was no longer being treated as a police matter.
Neither insurance company was involved and he paid for the minor repairs to his vehicle himself. Now out of the blue (at least six weeks after the accident) he has received a summons for careless driving. (Edited: sorry careless not dangerous driving)
So just after any advice as to how he should proceed, and to check how can they charge him with this when it's just his word against the other driver's?
Thanks,
Niki

Sorry dont really know the answer, just wanted to say that driving without due care and attention,is less serious than dangerous driving.
There are two sides to every story.

I would imagine the only thing he could do is to plead his innocence, however, I would construe his accident as careless driving on both his part and the other drivers I'm afraid, cars do 'not' just 'come out of no where'!!
Sorry to sound harsh, but that is exactly the way a court would see it!
Good luck to him....Halifax Personal Loan £23,000 :think:0
