Divorce - joint account advice

Hi - my mother has a joint account with myself, and looks set to go through with a divorce of my father soon - they are currently separated with no legal proceding currently initiated.

The joint account is a simple cash account with a bank that she pays cash into. None of the money is mine, but can my father have a claim on this money, especially if we argue that it's my money in there rather than my mother's?

It rather sounds like this is money that your mother gives to you, so I don't think there will be a direct claim on this account. All money that your mother has will be included in the matrimonial assets. For example, if she gives you money out of her savings and those savings accumulated during the marriage, then those savings would be included when they decide how to split things up.

When appropriate, you mother (and father) should seek legal advice and she should explain to her solicitor that this account exists and what it's for.
