    1&1 is USA Based.
    Really?

Looks like they have a UK entity.
    Their T&Cs say...
1&1 Internet Limited, a company registered in England and Wales under number 03953678 whose registered office is currently situated at 1&1 Internet Limited, Aquasulis House, 10-14 Bath Road, Slough, Berkshire, SL1 3SA, United Kingdom
Further browsing of those T&Cs confirms their understanding of the DSRs.

TBH, if it's a fiver and that's the end of it, why not just give them the money?

  • it dounds like you paid £5 for the domain name for two years. Hosting the domain will usually cost about £5 a month, they're not charging you for the hosting but as the domain name is registered in your name and unavailable for anybody else to sell... then that's what the £5 is for.

It pays to stand firm on these things and say NO!

The contract was for their mid range linux webhosting at £4.99 a month which turns out to be £6 because of VAT. After telling them they were useless and there was no way I was being held to a contract for 2 years after using it for only 2 days. They confirmed that if I called them they would indeed cancel the account and not chase the invoice. Time will tell if that is the reality but they have deleted my account now so they can hardly chase me to continue paying for 2 years for something that doesn't exist.

Don't give in people stand up for what is right! Companies with unfiar terms don't deserve to do business! Nor do those that are quite frankly useless!

Do you care to enlighten us as to the problems you had with 1&1?

As it stands you're in breach of contract. If you're dissatisfied with the service they're providing, there are far better options than just pulling the plug, no warning, giving them no opportunity to resolve your issues and without paying what you agreed to pay.
