hey guys, ive just recently had a successful payout from my barclaycard for the late payments. now i want to go to my capital one account and do the same for the PPI.
i was very annoyed cause over a year ago i spoke to them to cancel it, then i recently noticed i was still paying it, i rang them up and they said they had no record of our conversation, so again i cancelled it.
after reading martin article which says ask for the original agreement ive just noticed that i ticked no for the payment protection plan anyways and they still went ahead and charged me, so its not even a case i was missold i actually didnt want it and they went ahead with it anyway.
the agreement was taken out back in 2002 but the account is still open.
do i have to go down the same route as if i were missold or are there other options for me?? also i need to get all my previous statements from them as they only provide the last 12 months online for me to see.

Personally I would then write a letter of complaint on how unhappy you are on how they have dealt with this matter, ask that they refund you from the original cancellation request, plus interest to date.
As its not a case of mis selling, a letter of complaint is fine.

trouble is theyve said theres no record of the when i first cancelled and i cant prove the date.
as the account is 10 years on they must ow me a fair wak now so would it no be better to reclaim it all. ive got the proof that i didnt want it so i may as well0 -
You could request for a Subject access Request (SAR), they should hold the details of this account from when you first taken this out, especially if still running, or at least the last 6 years if settled.
To SAR, there is a template letter below, they have 40 calendar days to comply to this, and you enclose the one off £10 cheque or postal order.

well ive printed out the letter asking for a comprehensive list of all my insurance charges, is it worth sending that first or going straight into the sar?
will they have copies of all our telephone conversations cause ive had several with them and wouldnt be able to recall the exact date of the conversation in hand, just no it was some time after i got back from traveling early 20100 -

LOL, it does not matter, you can still continue to complain whilst waiting for the data of your SAR.
If the call was made over recent years of cancellation, they should at least have written transcripts of the calls, even if they do not have the actual disc to send.;)The one and only "Dizzy Di"
