Dla question

Hi there just wondered if anybody would be able to help me out here. I am on maternity leave from my part time job at the moment and due to go back in a month or so. My OH is on Incapacity Benefit long term rate. He has recently also qualified for DLA low rate mobility and low rate care due to his condition worsening. I am very worried at how he will cope with the baby when I return to work. If I dont return to my job, and stay at home to care for both the baby and my partner, I cant claim for Carers Allowance as he has only been awarded low rate. I therefore cant claim for Income Support, and as far as I can see the only benefit I would possiby be entitled to (although maybe not straight away if I left my current job) would be Jobseekers Allowance. Obviously this would defeat the purpose as I still wouldnt be able to stay at home to care whilst job seeking. Has anyone got any info on this? Do I have any other options? I cant claim childcare under Working Tax and put baby into a nursery as they see partner being at home as not needing childcare. Have googled and googled but just going round in circles! Any help much appreciated thank you.

    What is the nature of his disability, Im not being nosey btw, its relevant to your query.

    He unfortunately has a wide variety! But the mains are a skin condition, anxiety and depression and vertigo. Thanks for your reply.

    How does his anxiety and depression manifest itself?

    You can under some cercumstances get tax credits for childcare if you can prove that your husbands disabilities mean he is a danger to the bairn, not a pleasant prospect to prove but the means justifies the ends in this expampl.

    Thanks for your reply, his anxiety and depression at its worst means he wont go out of the house, wont attend appointments (of which he has a lot of for various conditions), and even if he did he wouldnt go alone. He has panic attacks, where he cant talk to people not even on the phone especially people he doesnt know. It makes things difficult BUT I'm not sure I could say he is a danger to the baby :(

    Would I be able to NOT claim a benefit? Not return to work, but not claim any money for myself? I know this would mean we would struggle even more but for the peace of mind that I would be there to care for both the baby and OH. Could this work?

    Hi thanks for your reply and the answer is no as I've googled and googled and can't find anything about this type of situation

    Would not working and not claiming a benefit render me unable to claim CB or CTC?

    I knew it would stop any WTC obviously but would it stop those too?

    Sorry I'm a bit clueless I've never not worked and am finding the whole thing a bit of a minefield tbh.

    you would still get CB and your CTC will increase if you stopped working but i don't know about the rest cant he go esa?

    can't he claim for the both of you as when you have a baby one parent is allowed to stay at home to look after it and if he is on IB then surly uou can. the best thing is to go to your local CAB and get advice, they are brill!

  • TBH i would just either contact the CAB or the DWP, explain your situation re o/h and ask them your options. Make sure you tell them your o/h is on DLA and not capable of looking after the baby on his own. I'm sure in your situation you would be entitled to tax credits and child tax credits plus as raven said can he not claim esa as well
