Today i has my first accident in 22 years of driving.I was basically hit up the ars e by a driver who was using a mobile phone. I rang the police to inform them but they said as no one was injured to just inform your insurance company.I didnt mention to the police the other driver was using a mobile at the time of the accident.Does this fact make it a reportable incident (to the police)?

its is correct that if no injuries where immediately sustained at the scene of theaccident and both parties swapped details then there is no involement for the police to take. how did u assertain that the driver was using a mobile phone when they hit the rear of your vehicle.
personally i hate drivers who use mobile phone and only get fined £50.00..... as if that is some deterent. you could report the matter to your local police stattion and then they could decide wether there is enough evidence to prosecute the other driver0 -

She still had it in her hand against her ear for about 10 seconds after the impact, she also admitted it when i gave her a barrage of abuse (although she denied reponsibilty for the accident)-....-.---.---. ..... .- -.-.

depends on the police force - if they where to be sucessfull they would have to get the network operator to confirm she was on the phone at the time of the accident. some forces are more hevy on mobile phoe driving than others0

She hits you at the rear and then denies all responsibility
:rotfl::rotfl::rotfl::rotfl::rotfl:make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Most forces will not attend damage only accidents (and there is no obligation on the drivers to report them) but may have a policy to attend if there is an allegation that the accident was caused by a serious error (rather than a momentary lapse of judgement). Check what their policies are (use the Freedom of Information Act if necessary) and if the accident wasn't dealt with as their policy suggests, make a complaint.
However, it will be your word against the other driver's, so don't expect too much!We need the earth for food, water, and shelter.
The earth needs us for nothing.
The earth does not belong to us.
We belong to the Earth0 -
Update- i have just rang the police again to inform them of the accident stating the other person was using a mobile phone and the response was unless the police witnessed it then its my word against the other persons and therefore no crime had been committed . (even though i have an independant witness who saw what happened).-....-.---.---. ..... .- -.-.

What about phone records showing that she was making a call at the time of the accident?0 -

I think the police will be aware of what they can and cannot win when trying to charge people with using a mobile whilst driving. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
In all honesty it's still better to go in and report the accident at police station. Happened to me, the other driver gave a false address, by the time insurance company caught up with him, his car had been repaired and he denied him or his car was on the road at the time of the accident, take as many pics as possible and gather as much evidence as possible.4 Stones and 0 pounds or 25.4kg lighter :j0

Police simply arent interested in these kinds of things 99% of the time unless they happen to be doing some form of particular drive against it.
Hand the matter to the insurers and they will resolve the claim for you.0
