Egg and Capital One reject claim

Sent of a complaint to the above companies as PPI was never needed due to company sick pay covering the full wages and partner more than able to cover repayments. I have had letters back rejected the case on the basis of;
Egg - Form was filled out online and the box was ticked to ask for PPI (it was already filled in we actually selected to have it.
Capital One - The original card had no PPI on it but when a new card was issued they state they never give any advice on the PPI, the salesman offered the insurance with no advice and we agreed to have it. We did try to call 3 years ago but the pushy call centre wouldnt take no for an answer so we eneded up just leaving it on there
Any advice on where to go next?

If you've received a final decision letter from the company after their complaint investigation it should advise you that you can take your complaint to the Financial Ombudsman Service if you're not happy with their decision.Many thanks to everyone who posts competitions and works so hard to provide all the answers!

Thank you, yes they have advised that. Im wondering in the case of Egg where they state a box was ticked, I honestly cant remember! If it was do i have any case. The insurance would never have been needed but I'd imagine it was the person applyings fault? However, i would still like the money back ha ha0

Everyone's circumstances and mis selling reasons differ, so for example, if it was an online purchase, it was possibly an opt-out matter, so where it may have already been pre-ticked, it was a matter of unticking it.
However, its been known going by some posts, that when they've unticked, the application would not allow to go any further, and another one was they may receive a phone call later on.
You have the opportunity to complain to the FOS now, so I would therefore go that direction and enclose any evidence you may have or further information to support your complaint.

Hi Mudd14, i had the same response from Egg, it was an online app from 2001 & i ticked the box?
Sent it all to FOS & got a response from them yesterday that Egg have done a U turn & they will now settle my claim as a gesture of goodwill:eek:
I was very suprised, i am now awaiting a letter from egg to see how much they are going to offer. I would deffo advise you take it to the FOS as your next step. You have nothing to loose, good luck!0 -

I have had a similar letter from EGG. And got a letter from the FOS on saturday saying that they will be looking into my complaint.
