New Generation Parking - new tactic

Hi all

I've been reading all of your posts regarding New Generation Parking and Graham White Solicitors as I've been given an invoice to pay too. My car was parked in pizza hut down at Cardiff Bay for 10 minutes and a few days later I got sent a lovely letter from NGP. I've ignored this and the subsequent letters from GW solicitors

However, I've just had a phone call from someone at GW solicitors informing me of my outstanding £200 odd balance. Don't know how she got my EX DIRECTORY number but she claimed it was supplied by a credit reference agency.

The conversation went:

Her: your balance is £217. this is your chance to pay it before it goes to court.

Me: I'm not paying it.

Her: Why aren't you going to pay it?

Me: because you know as well as I do that it is non enforceable and that you must take me to small claims court if you wish to try and recover it. Good luck with that!

Her: under contract law, you entered into a contract...

Me: hang on there! I'm not suggesting that I was or wasn't the driver but IF I had been driving, I didn't enter into anything. Even IF I did enter into the contract, you show me what loss your client incurred as a result of my car being parked there for 10 minutes.

Her: under contract law....

Me: I'm not paying

Her: but under contract law...

Me: I'm not paying or discussing this any further with you.

Her: then my client may consider taking you to small claims court.

Me: see you there. I'll wear a pink carnation so you know me. Bye!

This is clearly a new tactic by them to frighten people into paying so beware.

Hardly a new tactic , well documented in fact.

I would advise against trying to reason with these idiots.

    The reccommended response is :-

"The debt is denied and as such you may not continue enforcement action you must refer the matter back to your client as per OfT guidelines.
Any further contact from yourselves as Graham White or Roxburghe will be reported as harassment to the OfT, Trading Standards and the Police. Goodbye."

Phone down and get on with your life.

Brilliant you have just confirmed they have a live hook.
    The harassment will increase.
Next time, never answer to your name on a telephone, ask who is calling first and their reason for calling, if they refuse terminate the call.
If they say, place the handset down and leave off the hook for a while so they can not ring straight back, keep doing it and they will get fed up

As you have probably discerned by now the caller identifying themselves as Graham White's solicitors, are in fact none other than our old friends Roxburghe's debt collectors who are currently under investigation by the OFT. They have been told that the OFT are minded to revoke their debt collection licence and this might not be completely unconnected with their posing as solicitors as the mood takes them.

Roxburghe's like all debt collectors thrive on supposed debtors engaging with them - because they then know they're on target. Unless you have been informed by New Generation that they have sold the debt to Roxburghe the latter are talking out of their rear end - as though that's unusual - about their ability to institute proceedings.

BTW - NGP are not actually based in Caerphilly Road. That's just a drop address. Their head office, together with that of a number of other seemingly unrelated parking companies, is actually in a small business centre in north London.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
  • They're citing the law now are they?

I'd have asked her which chapter and verse dictated that you need to pay the demand when it was neither known for sure that you were the driver and where actual losses can be pushed aside to make way for de facto penalties - or it wouldn't be de facto in this case, but de jure. Perhaps she could have read it for you.

And I'd also like to know where she gets off thinking she can continue to harass you and cite "the law" after she already pledged court action and you in turn invited her to follow through.

If this isn't harassment, what is?

You can not argue or reason with them, they are scammers, crooks, liars and thieves. they leave live bait out for you to pull at, getting you engage is how the scam works, you will not be proven right, because they are no rules, they make them up as they go along, so dont try to play the game and you will save yourself a shed load of hassle.
