Black Horse PPI!!!!!!!!!!!!!!!!!!!!

Hi I am a long time lurker but this is my first post so please be gentle!
I currently have four claims for missold PPI in with Black Horse each one is a personal loan and each one paid the previous one off early (hope that makes sense!). Right from the very first one I was told that unless I took out the PPI I wouldn't get the loan as I had a mortgage in just my sole name and also I had a not so good credit rating. On the loans after 2002 they also said that as I was a single parent that I certainly wouldn't get the loan accepted without it!! How young and silly I was back then to believe this!:mad: I have always been in employment and my jobs have always had good sick pay i.e. full pay for 6 months and then half pay for six months and I pointed this out in my meetings however again was told I wouldn't be accepted without it.
I know that this is what happened as I do have a very good memory (my DH says its a curse!) and I can even remember the name of the person who processed my last loan and that was back in 2005!
Anyhow the reason for this long ramble is that yesterday I received a letter from BH in respect of the first loan and the claim hasn't been upheld they have sent what seems to be the generic letter stating I would have had it all explained to me and that I had 30 days to cancel and therefore they don't think it was missold."
Well yes they may well have explained to me what it covered and that i had 30 days to cancel but they also said i had to take it out or not be accepted even when i said I was covered for sick through work!!
So my question is how do I take it further as I do not intend to just leave it there! Can I go back to BH or should I go to FLA as they suggest?

Hi there
The cover was worthless to you and it was not sold in your best interest, so you can either give it another go by writing back, tell them they missed your points on your complaint totally, and you are asking them to reconsider.
Give them 14 days.
Normally in the final response they confirm its final and enclose details and the leaflet of the financial ombudsman service (FOS) if your eligible to go that direction.
Did they actually mention the FLA then?
These are the financial leasing association and they are suggested to fo this avenue and not the FOS if the business were not regulated at the time of the sale of that actual policy.
However, going by posts on here, the FLA are not that helpful, but you could give it a go if this fails on the next letter, or if you hear nothing by 14 days of sending a reconsideration letter with further information.
The FOS will only be able to adjudicate complaints if the business were then regulated by the FSA prior to these regulators GISC.
But if you contact the FOS (if all else fails), they may suggest going the underwriter/insurer avenue of the business as another avenue of trying to get your money back to you.

I would give any further information that may help your case, and that applies to you, and in my opinion there is no harm in mentioning about other businesses where they did not sell the ppi to the loans etc, thats up to you.

Thank you Di for your reply. I will get the letter sorted tomorrow I intend to fight this all the way because I know they are wrong and also as we are about to start on a DMP any money received back would go a long way to clearing some of the debts!!0

My partner was told exactly the same when taking out a loan with Black Horse 2007. It seems that this could well be a standard practice of Black Horse in those times. She has recently tried to claim this PPI back, only be sent a letter saying that the PPI was optional on the documentation and she had signed to accept it. This was at a time where we had just had our second child and I had been made redundant, so obviously she accepted the salesperson telling her she would not get the loan unless she did sign up for PPI.
I think they need to accept that their sales practices at the time were both unfair and back-handed. The more people who were told this the better our case to reclaim OUR Money!!! Yes I was told I needed it or else I wouldn't get the loan. Thankfully this complaint was upheld even though the two previous loans had their complaints rejected.

Hi, I too received the same rejection letter from BH stating that I'd 30 days to cancel the insurance. I have written back to them (sorry this is long...):
I am extremely disappointed to receive your letter dated 16th September (received today) that you have not found grounds to support my allegations that I was mis-sold PPI. As you have been unable to satisfy my complaints I shall briefly summarise again why I was mis-sold this policy:
Your salesperson stated that taking out a policy was a pre-condition of applying for a loan, your salesperson was clear in advising me that taking out the policy was essential for me to get the associated credit even though I informed them that I felt I did not require the cover. At the time of this application I was in full-time employment with no risk of redundancy, a fully paid salary for 12 months of sickness had life insurance and critical illness insurance policies. It has only become apparent to me after the recent coverage by the media, and following the recent OFT and FSA investigations regarding the mis-selling of PPI by finance companies. Regarding the loan with the PPI applied, I believe I that I have been gravely mis-led and have been mis-sold this expensive insurance that I did not need or want. As an existing customer of yours for a number of years now I would like this complaint readdressed.
I enclose a copy of the Demands & Needs Questionnaire that was completed when I took out my second loan with you in 2007. Your Personal Recommendation states ‘no additional cover for repayments was needed’ and if those questions had been asked when I took out the first loan my answers would have been the same.
No attempt was made to ascertain if the product provided was fit for purpose, suitable for my needs or if indeed it at all. No inquiry was made as whether I had pre-existing insurance for accident, illness or unemployment. At no time were any rights to cancel explained. Having been told by you that the insurance was a condition of the loan why would I even attempt to cancel it when the loan was granted? I believe you manifestly failed in your fiduciary responsibilities, your duty of care.
I understand under the Consumer Credit Acts and following a House of Lords judgment that you are not allowed to make a loan conditional on taking PPI unless you include the costs of PPI as part of the charge for credit and not the credit itself. You added it to the total for credit and then charged me further interest on the premium on top of the interest for the loan which is unacceptable.
I am now sending you a letter before action giving you a further 14 days in which to reflect. I believe that this time frame is sufficient for a large company such as yours with its dedicated staff and departments.
After that, there will be no further communication from me and I shall pursue a claim through the FLA, Genworth Finance (as the underwriter) through the FOS and latterly the courts at the expiry of this second deadline.
