    Are you saying that you were not married?

    Were you named as the sole or joint beneficiary of the policy? Or not named at all?

    Were the children named as the sole or joint beneficiary of the policy?

    Or was it unamed and would go to next of kin?

    If you were named then it was your money and not the childrens whether ot not you were married. Anyone can be named as a beneficiary of a policy.

    If you were not named and you were not legally married then it would go to those named in the will or if no will then the next of kin. This would be the children and depending on estate value i think it could also be the Parents (this is from experience- not legal background).

  • No we were never married and nobody was named on his policy. I applied for probate on behalf of the children which was then granted. All correspondence I received in connection with this highlighted that the estate was to be split between all three children and only accessed once they turn 18 x
  • Ok. Then it was never your money as you were never next of kin and you were not a named beneficiary. You have not deprived yourself of assets as the assets were never yours.

    You need to explain it to the benefits office with a copy of the probate. Sounds like you acted as an executor (or did some of the functions of the executor).

    Just get in touch and explain this.
