I posted the other day about our house been on the market since the beginning of November and no viewings! The EA has made numerous mistakes---firstly it was over priced to the tune of 13k for 6 weeks---the valuer is no longer working for them and they apologised saying yes she did make a mistake!!Then, when i checked it on the websites it had 3 pictures on that werent even our house!!
I have obviously complained and they said they are making us their first priority but I havent heard anything from them for the last 2 weeks!!! I would really love to be able to leave this EA---we are tied in with them til March!!!I have rung them today and the main boss is back in the office at 5 and I am expecting him to ring me then.
At the very least I would like to ask if I can put it up with another agent as well as them. Can anyone please advise how I can word it when i speak to the boss. My OH is happy to sit back and let this EA have our business til March----I really dont feel at all happy with them!!! We have seen a house we would love and therefore we are probably going to lose this if we just sit back and wait.I havent sold a house for 18 years and I have completely lost touch with it all!!

I'd send them a letter saying that in view of the fact they haven't acted professionally you're rescinding the contract with immediate effect (make sure you have printed off a copy of the wrong photos attached to your house details and have a list of everything else they've messed up). Then go ahead and get new agents to value the place - I'm sure your agents will continue to be rubbish even if the top man calls today.
If in doubt have a chat with your solicitor (he'll probably roll up this advice in the overall bill for your sale and purchase.)0 -
I'd say the agent hadn't fulfilled their part of the contract so you would be within your rights to tell them to get stuffed.
It seems an awfully long time to be tied into an agent, though. Are you sure they have sole agency for that long (their incompetence notwithstanding)?0
