Fiat Car Under Warranty

Hi i purchased a new fiat punto into Jan 09 so it still has 5 months left on warranty. It has had numerous faults throughout warranty and i have complained to Stoneacre (the dealer) and fiat themselves about the quality of the car. At the start of Sept the gears had issues which they repaired and last week reoccured nearly causing me a serious accident. They have repaired again but i now want to reject the car. Instaed of helping me Stoneacre just had a sales guy ring and try to sell me a new car which i wont have from them, they say they have valued my car at 4,500 however i know i can sell it privately for 6-7000 as deisel with no issues other than what have been under the warranty. I want Stonecare to pay the 7,000 i can get privately is this unreasonable? i refuse to let them take advantage of me and im willing to take legal advice if neccessary again is this too far? i feel i am not being unreasonable i dont want to sell it privately myself because i dont want to sell someone a car i know to be faulty. Please help this is now causing me a lot of stress and upset.

    You won't get any of what you're asking for - 2.5yrs of use, its got a 3 yr warranty, At best you could ask for an extension of the warranty at no cost to you - improved peace of mind for longer.

    But to be honest, they've fixed it when it went faulty, there is no legal right for you to be bought out at a higher price, on indeed, I suspect any legal recourse should you choose to take them to court (I personally really can't see what for).
  • i guess what im finding very frustrating is i can sell privately for upto 7,000 but if i do that ill have to either tell the buyer the histiry of faults and take less money or dont tell them and be responsible for selling on a faulty car i feel stoneacre should buy it for what i would get through a private sale

  • lol yeah i got that now. Thing is isnt this what the standards of goods act is for? i paid 11,700 for a new car that has had numerous faults surely its not to the quality stardard it should be? im not asking for my money back or for a new car just for stoneacre to take responsibility for it

    why would the dealers pay you £7k? you are in 3rd year warranty(you realise thats different from year 1&2?)
    they are offering a trade in price so they can make a profit or at best no loss
    the times for rejecting the car were really quite some time ago

    what were the 'numerous' faults?
  • In the first year it had 3x electrical faults where dash kept losing all dials. i conplained to fiat and stoneacre and fault fixed on third time but it was intermittant so i had to wait until the fault was there and stayed there while i got it back to stoneacre.

    In year two it went back for losing power and indicator problems and has now been back twice in two weeks for gear problems the last of which nearly caused me a serious accident.

    I can quite happily sell it privatley and i realise why its less to a dealer but my point is someone else will be getting a faulty carand only a few months of warranty isnt that unfair and letting the dealer off easy?

    I think you are seriously overestimating what it is worth, the three year old Puntos on Autotrader are priced between roughly £4K and £6K.
  • just looking for a few mins just now the first three i found diesel punto grande all were over 6K? im not trying to be difficult just sad and feel abit screwed over maybe id be best just selling it on and making it someone elses problem

    Baring in mind you were picking up brand new unregistered MJet Sportings in the second half of 2009 for £9800 (I know as I almost had one but ended up with a Bravo) I would be surprised if your car was worth what you are looking for. Just because something is advertised doesn't mean its selling!

    Ah well, we didn't know it was a Grande until now. I guess you'll get a bit more than a normal Punto but I still think you're looking at £6K if you're lucky and no chance of £7K.
