Fence blown down, who pays

Due to the high winds we have been experienceing up here in the North East park of my fence has blown down and will need to be replaced.

Who pays for it? We live in a semi but the fence is between us and next door (nor ajoining) separating our two gardens.

How do I find out who is responsible for which boundary?

Any thoughts would be appreciated.

    I think it states in your deed who owns what.

    That damn wind has blown some slates of my roof as well

    It should be in the deeds. Some times if fence posts are to one side of the fence, the person responsible has the posts in their garden. In a lot of older houses it can be very vague and uncertain.

    some people say it depends on which way the fence is errected (ie posts your side or not_ but thats not always the case. For example where my house is because of the lie of the land and houses built at different times i am responsible for all 3 sides!!! Bummer eh! the only way to check for sure is your deeds. Maybe its worth speaking to neighbour and see if you both go half?But I dont think they have to do anything if they dont want to if they are not responsible it just depends on your neighbours
  • Thanks for the replies but I'm not too sure where my deeds are, got to say i'm a little worried about that! I'll have to have a look for them tonight.

    if you have a mortgage i would think they would be with the lender.

    I have the same problem, only its my neighbours fence and 2 panels have come out, but I know she wont do anything about it, as her garden is a state as it is, and I am concerned that all her overgrown Kr@p is going to come into mine, and she is not very approachable at the best of times.:rolleyes:

    Your side is normally the right side of the house.

    If you stand at your front do for example, then the right side is yours, therefore the back would be your left as your standing at your back door.

    You can check your deeds online, google the land registry and you can pay £2.00 ish to download the deeds which will outline your boundaries

    In my current house, the right side (as you look from the house) and the back are my responsibility. In the previous house it was the other way around.

    You can tell by looking at the sketches, and going by the way the "T" points on the fence. If it points into your garden, you are technically responsible I believe.

    Assuming it's just a panel or two that need replacing, (and you get on with your neighbour), I'd personally offer to go halves on the cost (standard 6ft x 6ft fence panel would be about £15 each to buy from Wickes). That's just my opinion, and I suppose technically you would be agreeing to maintain something that isn't yours.

    If it's an old fence the wrong side of the fence and posts mean it's very probably yours. It will be on the deeds to your property highlighted in red/blue. If you neighbours are very nice and you are stuck for cash they may share the costs .
