Mobile phone repair

I purchased a mobile phone from phones 4U on 27th April this year. At the beginning of this month the phone developed a fault whereby it was failing to recharge, hence I took the phone back to P4U and they sent it off to their repair centre.

On the 12th September I recieved the phone back, enclosed was a letter stating that an engineer at the Manufacturers repair Centre has examined my phone and discovered that the fault is related to ecxessive pressive or physical impact damage, and not a manufacturing defect. Thus they deem the handset to be beyond economical repair and that this type of damage can't be repaired under the manufacturers warranty.

1.) the phone has suffered no physical impact of any kind, nor excessive pressure neither does it show signs of any neglect.

2.) the repair centre removed the faulty part (charging point) and have sent the phone back minus this part. i assume it would be a charging point connected to a circuit board.

As a result of this I contacted Nokia, whom told me the phone was under a 2 yr warranty and they collected the phone from me. Today the phone has been returned unrepaired, Nokia quoting that the warranty seal has been broken on the handset (P4U) and thus the warranty is now void.

With the fault being reported within 6 months I was under the impression that it was down to the retailer to prove that the product had been mistreated?

I'm now left with 18mths remaining on my contract and no phone. Any help would be greatly recieved. The phone is a Nokia E70

    Try get an independent report done on the phone, then send it to phone 4u.

    why?

    The retailer needs to prove the damage - I would actually be asking why P4U have returned the phone with the part removed - if they removed it they either need to put it back or they need to repair it, one or the other.

    As because of P4us actions nokia now wont even look at the phone.

    The retailer believes they have proved the damage, they took it apart and inspected it, saw the excessive force, what more proof do you need. The op will now need to counter that evidence with their own report. The six month rule is all very well but if you can't get the retailer to blindly agree to it then you need to take your own action against them.

    As visidigi says, why did the repair centre not send the part back to the OP? It belongs to the OP, not the repair centre. At the very least if they had returned it the OP could have shown it to an independent phone repairer to get a report written. By them not returned it, the OP now can't get a report to back up his claim.
  • When I contacted P4U they clarified that the phone didn't seem to have been subject of any missuse just that it has been charged too many times, and the connector had snapped. They conceded that this wasn't my fault, but neither was it theirs and thus deemed the phone beyond economical repair. However, when asked that they put this in writing they declined.

    Really doesn't help the situation or the frustration.

    "Charged too many times"??? What an unbelievably pathetic excuse from P4U - you only bought the phone in April. Even if the connector had snapped, where is it? It belongs to you, and would be vital if you want to get an independent report done.

    You should ask them for it back, and if they say they don't have it then escalate it to P4U's head office - say you want to get an independent report, but can't as they're withholding the only bit of evidence there is. Also tell head office about the "charged too many times" excuse, and ask what is the max. number of times you should charge a phone. I'd be telling them it's not fit for purpose, as a phone would be expected to last more than 6 months' worth of charging.
