Compensation affect non-means test benefits?

  • Me again!!

I just done some reading from here: http://www.dwp.gov.uk/docs/gl27-print-version.pdf

It is about compensation and social security benefits. Not sure if it will help you.

It seems to talk about benefits you have received as a result of the accident. It does not explain the impact of compensation on benefits if you were already on the same level of benefits prior to the accident.

It mentions DLA but then if you were getting it prior to the accident maybe that is not taken into account. Well at least I am hoping so as I was on highest rate DLA prior to the accident as well as IS.

Sleepless Saver - thanks for the link, I'm still trying to find the relevant part but from what you have highlighted, does that mean I don't have to declare the compensation as I receive a non-means tested benefit? I do not have any savings, just debt due to losing my job and that desperately needs paying...

It's a big document. Just scroll down to the start of Chapter 52, it's the very first bit.

As sunnyone says, I think any compensation payments are reported to DWP so that they can check if benefits are affected. Wouldn't usually be done by the recipient though, but there's nothing to stop you writing to them if it puts your mind at rest. In your case benefits won't be affected.

I can't see anything in this thread that overrides what it says in the decision makers guide at the reference I gave (and in fact elsewhere in the guide it appears that your type of compensation (no annuity payments) is also disregarded for income related ESA).

I don't know how it would affect your direct payments for care though.
