help please..royal mail lost ebay returned item.

Have just contacted royal mail and they think they have lost my first class recorded parcel.

It was for a computer part that I bought off ebay. It wasnt working so as agreed by seller I sent it back to him.

It now seems that after 19 days , royal mail have lost it.



I opened a case with seller through ebay as item not as described , but don't know what to do about it now.


Its not my fault the part wasn't working , but its not the sellers fault its got lost.


what happens if i make a claim with royal mail and seller suddenly receives it?
Sorry for so many questions , its all been a nightmare.


I dont know what to do now i just want to get my money back for a part that wasnt working?

  • Royal mail will contact the seller to see whether they have recieved it or not - If you have had your claim paid and closed then the seller recieves it then i would assume royal mail won't re-open the case. Did you get a tracking number?
  • I have not yet had refund from seller , due to him wanting part back.
    Yes i did get a tracking number , ive checked the status and it says royal mail has it as its progressed in their network for delivery.

    Do I ask seller to refund me and say that royal mail will then refund him when claim has gone through?

    Unfortunately not, it is not the seller's fault it has got lost as you rightly pointed out. Royal Mail will deal with you and pay any compensation directly to you as you are the sender.

    You will need to complete a P58 form (available from Post Office), and attach your proof of posting and also a copy of the ebay transaction to prove what you paid. Staple these to the form to ensure they don't get parted and misplaced, and make sure you keep copies of everything.

    Ultimately you will still get your money back, but now rather than the seller refunding you by Paypal you will have to wait for a cheque from Royal Mail.

  • If the seller is a business, under the DSRs if you were returning for change of mind and you have proof you have taken due care to return the item to them then it is the seller's responsibility to resolve. Whether the introduction of faulty goods into the equation affects this this I don't know.

    DSR returns are returns for any reason, not just change of mind, so yes, I would assume faulty items did fall under these conditions.

    They do however only count if the item was bought from a fixed price listing.

    It doesn't matter,OP has returned item with sellers agreement for refund.
    If item not received by seller OP claims from RM and gets refunded purchase price +postage(hopefully)
    Seller still has original payment for item and postage,all happy,RM pay for losing item.

    Case for SNAD should not have been opened until this was settled.(or getting near time limit)

    I think though that suggesting OP will get a refund as she can prove item was sent back to seller is rather giving false hope. There is no mechanism on ebay or paypal to allow this, unless of course it is being suggested that OP go to small claims? Wouldn't it just be easier to reclaim the loss from Royal mail? There is no rights under DSRs to have a refund if a seller has not been givien a chance to get the item back- and I wonder even if it goes to small claims if sending something back recorded counts as seller being given a chance to recover their goods.

    Recorded is a useless service and I wish the post office would be more honest about the possibility of it tracking when they sell the service.
