Parking Charge Notice from Total Parking Solutions

Newbie here. Apologies if this has been done before.
My lovely boss received a Parking Charge Notice from TPS this morning. It stated that she had over-parked in Asda carpark by 16 minutes.
It shows photographs of the front and rear of her car and the charge is for £60, reduced to £40 if she pays promptly.
I had read previous e-mails from MSE about private parking fines and advised lovely boss not to pay until we seek further information. Lovely boss is mortified and was about to pay the £40 today.
I would appreciate any advice as to whether this is an enforceable charge. Thank you.

Advise your lovely boss to totally ignore TPS but complain to Asda!0

You have not been given a parking ticket or a fine:
From a legal prospective what you have been given is an "invitation to pay a private invoice".
You are legally within your rights to reject the invitation and keep your money:
What will happen is they will buy your private data from DVLA and send a series of menacing letters threatening to take you to court and then more letters from fake debt collectors and fake solicitors again all threatening to take you to court.
They will not take you to court as legally they have no power to fine you or charge you a penalty.
In short it is a scam of impersonation of officialdom and empty threats.
HOW TO DEAL:
IGNORE everything, ignore all letters, ignore all fake solicitors letters and ignore all fake debt collectors.
They will get fed up and move on to another victim.
IGNORE Means exactly that IGNORE, you do not appeal, there is no appeal it is part of the scam, you do not bite back, do not write or do anything to correspond and they will go away, if they call your telephone, do not confirm any information place the handset down and leave it of the hook for ten minutes .
BE WARNED evidence on these and other forums clearly describes how people who do pay these hoping they go away receive further demands for more money, often several hundreds of pounds.Hi, we’ve had to remove your signature. Lovely boss has told me that there are signs displayed in ASDA carpark (which was free to park in) stating that that there is a three hour maximum time limit. Does this change anything?0 -

No, it changes nothing!
In fact, if they were ever to put this in front of a Court (which they will not, because that is not how the scam works!) then they can only do so under two pieces of civil law. Contract law and trespass! She was not trespassing, because they invited her to park there! If they allege you breached a 'supposed' contract for parking on the land then they would be only able to claim for the loss under the contract. As the car park was free that means they have lost a grand total of £0... so your boss owes them a grand total of... you guessed it... £0!!!
Write to Asda though and ask them why they are allowing their customers to be harassed for money they do not owe!0 -

Just to add to Vax2002 great post, look at the stickie thread at the top of the board and print off and prepare your lovely boss for the threatograms she will start to receive in the coming weeks and as he says TOTALLY IGNORE everything. If she does they will stop bothering you much quicker, if they smell blood by her contacting them, they will keep at her much longer!0 -

No problems, most of the posters on here have been a target of PPC's and got wind of their scams (some not before being a little lighter in pocket to a PPC!!!) and want to make sure as many people as possible understand this modern highway robbery!
Tell your friends and bosses friends... in fact send a memo around the company! :rotfl:0 -
Thanks to all of you for this ongoing thread. I am in receipt of my third scary letter. The charge is now £92 from an original of £30. I parked in a disabled bay (legitimately) at my local station. On return found the car park had been taken over by NCP, and I had incurred the "fine". Each time a scary letter arrives, I come back to the site for courage to continue to ignore - and get it from you lovely people. My husband is terminally ill and I find this harassment very difficult to take, without this forum I would have paid, although we can ill afford it. THANKS AGAIN!0
