    Observices Parking Consultancy Ltd v Thurlow [2011] - an appeal case where the judge ruled:
    • the charge amounted to an unenforceable penalty
    • there was no loss suffered as a result of any alleged breach
    • the common discount period reinforced the lack of provable loss
    • Arthur v Anker [1997] and Vine v LB Waltham Forest [2000] deemed irrelevant to ticketing cases.
    or perhaps, Excel Parking Services v Cutts [2011] - where the judge ruled:
    • the signage was too small
    • wording failed to make the terms clear
    • it was clear the emphasis was on catching motorists not on managing the car park
    or the succession of victories over Aintree NHS Trust

    Or the case where a trainee solicitor took Parking Eye to Court and got a refund after they had just been paid by a dumb Car Hire company. I am not sure why she didn't take the Hire Co to Court but good on Tasneem Patel, who did post about it on this MSE forum a couple of years ago.

    Surely the latter is a much more relevant case along with the Smith case, for Parking Eye to point to...but then they don't want people to know do they?!




    Do not ignore a private parking ticket - from 2013 onwards things changed in England/Wales. If yours is Parking Eye then they are suing people and so are some other PPCs.

    You must appeal and with current forum advice, you will win at popla - we win 100% of appeals in 2014.
